Legislation in Greece

Surrogacy is permitted under Law 3089/2002 and is legally protected, provided that the necessary conditions are met.

The IVF process and surrogacy are allowed only for medical reasons when a woman is unable to carry a pregnancy.

The surrogacy agreement must be approved by a court, which will review the legality of the agreement.

To become a surrogate mother, a woman must meet the following criteria:

  1. Be aged 25 to 45 years old.
  2. Be in good health.
  3. Have had at least one child of her own.
  4. Have not had more than two cesarean sections.
  5. Have undergone the mandatory medical examinations required by law.
  6. Have undergone a thorough psychological evaluation.
  7. Be willing to sign a private agreement with the intended parents and abide by its terms.
  8. Have the consent of her spouse (if married) and submit it to the court.
  9. The eggs to be fertilized must not belong to her, to avoid any future claims to motherhood.
